Overview

This Privacy Policy describes our policies on the collection, use and disclosure of your information in connection with your use of our websites, emails, services and applications (“Services”). When used herein, the terms “we”, “us” and “our” refer to Renovo Data Protection Services Inc. (“RenovoData”) and the members of our RenovoData family, our resellers, affiliates and subsidiaries. For the purposes of data protection legislation (and with exception to our Reseller partners, described further below), we are a data controller for the information we hold about you in providing our Services. As with the Services we provide, (i.e. data backup, disaster recovery, server hosting, and other services) we are a data processor, handling the controller’s data per the service agreement signed between us and the Customer. By visiting our website, www.RenovoData.com/privacy displaying the most recent copy of this Privacy Policy or a link thereto (a “Website”, “Site” or collectively the “Websites” or “Sites”), or by otherwise interacting with RenovoData, you agree to accept the practices described in this Privacy Policy. This Privacy Policy is further subject to the RenovoData Services Agreement related to the RenovoData services you utilize and/or purchase. When this Privacy Policy uses the term “personal data,” we mean any data that relates to an identifiable individual, including their name, address, online identifiers, payment details or email address. The specific data we collect is described in this policy and we encourage you to read it in its entirety.

Information We Collect

Contact information. We collect and retain personal contact information that you voluntarily submit to us by signing up for our products and services, requesting quotes, or any mailing lists. This includes your name, mailing address, web address, telephone number, fax number and e-mail address. Additionally, we collect contact information provided to us during any correspondence relating to customer support, as well as in connection with the products and services offered by us.

Financial Information. We collect and retain financial information you provide when you order our products and services. For example, when you apply to register for a free trial of our services or sign up for any other product or service through RenovoData.com, we may require you to provide a credit card number and billing address before we process that application.

Information on your use of our Website. We may collect information about the device with which your use of our Sites or Services, and information on your use of the Site itself, such as the domain name, Internet Service Provider, browser type and version, pages viewed, information accessed, and the Internet Protocol (IP) address you use to connect to the Internet. We also collect information in relation to Cookies –for more information, please review our policy on cookies listed herein.

Demographic Information. We may collect and store demographic information (your postcode, gender and age), and use this data to tailor your experience on our Websites, ensure you are at least 18 years of age to make purchases, provide content that we think you might be interested in, perform general improvements to the Websites, and display the content according to your preferences. Such demographic information may be shared with partners, market researchers and other third parties on an aggregate, non-personally identifiable basis. No personally identifiable information will be linked to such aggregated demographic information that is shared with third parties.

Telephone Recording and Monitoring. To ensure RenovoData customers receive quality service, we may select phone calls for recording and/or monitoring. These calls, between RenovoData customers (or potential customers) and employees, are evaluated by supervisors and/or other RenovoData representatives. This is to guarantee that prompt, consistent assistance and accurate information is delivered in a professional manner.

When using our Cloud backup and hosting services. RenovoData hosts or stores Customer’s data stored in a private, secure manner. RenovoData does not share any of this information with 3rd parties.

How We Use Your Personal Data

We use this information to perform our contract with you and fulfill your requests, such as:

  • Sending you the requested service information
  • Fulfilling your order;
  • Billing for services;
  • Creating directories (only when you explicitly ask to be included);
  • Responding to customer service requests, questions, and concerns; and
  • Administering your account.

Note that, generally, you may not opt out of these communications, which are transactional and not promotional in nature. If you do not wish to receive them, you have the option to cancel your services with us. We also engage other companies, individuals, and affiliates of RenovoData to perform certain functions and services for you. These third parties may perform functions such as; process credit card payments, provide marketing assistance, and removing duplicate information from customer lists.

If you have given your consent to send you email, phone or SMS marketing, or if you have provided us with your postal address, we will use the personal data you provide us to contact you from time to time. If you register on our Site, you can choose to provide your consent to receive marketing communications by email, phone and/or cell number (including use of automated dialing equipment and/or pre-recorded calls), text (SMS) message, social networks or any other means of communication that your device may be capable of receiving (i.e. video, etc.). If you do not want to receive postal or electronic communications, you may withdraw your consent at any time, by clicking the link in the communication or emailing us at customercare@renovodata.com.

Promotional Offers and Sweepstakes

If you provide your name for a promotional offer or to enter a sweepstakes or contest and you win a prize, we will post a winner’s list online where your name and city will be listed for our promotional purposes and to demonstrate the transparency of a competition, and we will file your name with state agencies if required by law.

To protect our Site and our business. We monitor use of the Services and Sites and we use the information we collect, including personal data, to pursue our legitimate interest in protecting you, others and RenovoData by:

  • Identifying fraudulent activities and transactions;
  • Preventing abuse of the Services provided and investigating and/or seeking prosecution for any potential threats to or misuse of the Services;
  • Ensuring compliance with the applicable terms of service and this Privacy Policy;
  • Investigating violations of or enforcing these agreements; and
  • Otherwise protecting the rights and property of RenovoData, its partners, and customers.

Improvement of our Services

In order to pursue our legitimate interest in improving our Services, we may use some personal data to conduct research and analysis and to identify what services you and other customers need. This helps us to better understand how people interact with our Services, and to provide communications about products which we think will be of interest to you, and to determine the effectiveness of promotional campaigns and advertising.

Whenever we process data for these purposes we will ensure that we always keep your personal data rights in high regard and take account of these rights. You have the right to object to this processing if you wish and if you wish to do so, please email customercare@renovodata.com to provide us an update to your communication preferences. Please bear in mind that if you object this may affect our ability to carry out tasks above for your benefit.

United States Customers

For services in the United States, by registering on a Website and providing your telephone number, you agree that this action constitutes a purchase, inquiry and/or application for purposes of telemarketing laws. Regardless of the fact that your telephone and/or cell number may be listed with the Federal Do-Not-Call Registry or your local State Do-Not-Call list, you are providing your express written consent to receive future information (including telemarketing) about products and services from us and/or our affiliates, and you hereby agree and consent to our contacting you using the information you have provided and will provide to us. This means we may contact you by e-mail, phone and/or cell number (including use of automated dialing equipment and/or pre-recorded calls), text (SMS) message, social networks or any other means of communication that your wireless or other telecommunications device may be capable of receiving (i.e. video, etc.). We may also send you information or offers from time to time to the postal address or email address we have on file (as further outlined in this Privacy Policy).

How Long We Keep Your Personal Data

We keep information only for as long as we need it to provide you services, manage our business or as required by law or contract. When you have a contract with us, we will retain your data for the length of the contract, and will further retain that information for a time period consistent with our legal or regulatory responsibilities, after you terminate all your services with us to resolve disputes, enforce our relevant Service Agreement, and to adhere to the technical and legal requirements and constraints related to the security, integrity and operation of the Services provided. How do we protect your information?

For Websites, we offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. RenovoData may have backup copies of Customer’s data. This data is kept secure and confidential, never shared with outside parties unless required by law.

Do we use cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information. We use cookies to compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

How long do we store your data?

RenovoData website information is kept for as long as an individual continues to consent to receive our newsletters, etc. For our Cloud Storage platform, information shall be kept for the duration of the contract, or if our customer decides to delete their data. In some cases, it is not possible for us to determine the periods for which your personal data will be retained and data retention will be determined by internal data classification. Do we disclose any information to outside parties? We do not sell, trade, or otherwise transfer your personally identifiable information to outside parties. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

Third-party Links

Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We, therefore, have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

Where We Transfer Your Personal Data

Our Sites are operated in the United States. If you are located in the European Union please be aware that information we collect will be transferred to and processed in the United States. As it relates to some Services, some Services or Sites could be operated in the European Union, but some data may still be hosted in the U.S.

EU-U.S. and Swiss-U.S. Privacy Shield

RenovoData adheres to the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce with respect to user notices and choice, as well as data transfer, data security, data integrity, data access, and overall general liability.

This adherence implies that information deemed as personal information, transferred between European Union (EU) member countries / Switzerland to the United States will be received and processed by RenovoData or any subsequent transfers to a third party acting will comply with the terms in this privacy policy and the Privacy Shield Principles (collectively, the “Framework”). For purposes of adhering to compliance of the Privacy Shield, RenovoData is subject to the investigatory and enforcement powers of the United States Federal Trade Commission. In as such, RenovoData reserves the right to disclose personal information about any individual as required by law enforcement, regulatory, government agencies, or national security obligations/requests.

In compliance with the Privacy Shield Principles, RenovoData has committed to resolve complaints about the collection or use of personal information. Individuals who may have a complaint shall submit the complaint directly to RenovoData to allow for an opportunity to resolve the issue. RenovoData shall investigate and attempt to resolve any complaints or disputes within 45 days of receiving the complaint. EU and Swiss individuals with inquiries or complaints regarding the Policy Shield policy shall contact RenovoData at the address below:

RenovoData shall cooperate with the panel established by the EU data protection authorities (DPAs) with respect to Human Resources related data and unresolved Privacy Shield complaints concerning the content and usage of such data which may have been transferred from the EU. RenovoData shall refer any unresolved Privacy Shield complaint to JAMS EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield Framework, who serves the role of an alternative dispute resolution provider which located in the United States. Individuals who believe that RenovoData has not addressed a complaint to their satisfaction may contact JAMS at https://www.jamsadr.com/eu-us-privacy-shield for further information and assistance at no additional cost. Under certain conditions, individuals may invoke binding arbitration by delivering written notice to RenovoData at the contact information listed above.

European Union General Data Protection Regulation (GDPR)

The GDPR applies to businesses established in the EU and can also apply to businesses established outside of the EU which offer their products and services to their EU business customers. These EU business customers are subject to the GDPR and are required to flow-down their GDPR obligations onto their non-EU providers. RenovoData is working diligently in its preparations for the GDPR. Employees, together with advisors are working on GDPR compliance.

These efforts include a review and update of our internal processes, procedures, technology and documentation in accordance with GDPR Requirements and Subject Access Requests. Implement relevant policies and practices to ensure the protection of any data handled by employees, customers, suppliers, and partners. Undertake a systematic review of the personal data we store, manage, maintain, collect, process and control.

RenovoData cooperates with EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) and comply with the advice given by such authorities with regard to human resources data (HR data) transferred from the EU and Switzerland in the context of the employment relationship.

In the context of an onward transfer, RenovoData has responsibility for the processing of personal information it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. RenovoData shall remain liable under the Principles if its agent processes such personal information in a manner inconsistent with the Principles unless the organization proves that it is not responsible for the event giving rise to the damage.

Your Rights

European Union’s General Data Protection Regulation or GDPR, provides individuals with specific rights in regards to the personal information we hold about you. Data collected in the EU and Switzerland and transferred to RenovoData outside of the EU or Switzerland may provide you with the following rights:

  • To file a complaint and obtain appropriate redress from any entity that originally obtained and processed your personal data.
  • Compensation with respect to damage suffered by you as a result of a breach of the Privacy Policy by any RenovoData entity to which the personal information may have been transferred.
  • The right to file a litigate complaint with a recognized data protection authority and/or to take action through a court to enforce compliance by RenovoData within the terms of its Privacy Policy
  • The right to access their personal data and some details that individuals will have the opportunity to correct and update Personal Information where it is inaccurate.

Geographic Restrictions

The RenovoData websites are designed to comply with the laws and regulations set forth by the United States. RenovoData retains the right to publish our websites or website content and may not be legal by certain persons or in certain countries. Individuals who access the website from outside the United States, do so by their own initiative and are responsible for compliance with local laws.

California Online Privacy Protection Act Compliance

We value your privacy and have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We will not distribute your personal information to outside parties without your consent.

Children’s Online Privacy Protection Act Compliance

We require customers to be at least 18 years old to purchase our goods and services. We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), we do not collect any information from anyone under 18 years of age. Our website, products and services are all directed to people who are at least 18 years old or older.

Resellers and Private Label Partners

As it relates to RenovoData’s trusted resellers and private label partners (collectively, “Resellers”), RenovoData may process customer Personal Data on behalf of Reseller. In such cases, Reseller is the data controller and RenovoData is the data processor and each party’s obligations will be outlined in the Reseller Agreement between the parties. In the event of a data subject access request sent by a third party to a Reseller, Reseller will make a similar request to RenovoData by contacting their representative or emailing accounting@renovodata.com and submitting the appropriate information. All data collected through this relationship will be treated in accordance with this policy.
